S. According to the National Highway Traffic Safety Administration (NHTSA), there were 765 work zone fatalities in 2016, which marked a 7% uptick from the previous year. In 2015, in addition to motor vehicle-related fatalities (the majority of which were in construction zones), 35,500 people were injured in work zone crashes, as reported in the 2017 edition of the National Safety Council’s Injury Facts.

To mark the beginning of the road construction season and to prevent further incidents, the 19th annual National Work Zone Awareness Week (NWZAW) has launched and will run through April 13. Organized by the U.S. Department of Transportation’s (DOT) Federal Highway Administration, this year’s campaign is “Work Zone Safety: Everybody’s Responsibility,” and aims to encourage safe driving through highway work zones.

The week kicked off today in host state, Illinois, at the Peoria Street bridge over Interstate 290 at the Jane Byrne Interchange reconstruction project in Chicago. Joined by the DOT, as well as other national and local partners, Illinois will hold events to raise awareness for safe driving practices in work zones. The Illinois DOT’s page states:

The Jane Byrne Interchange work zone emulates the Department’s goal toward a multimodal transportation system and reinforces the message that driving habits impact motorists, cyclists, workers and pedestrians. Whether you choose to drive, walk, bike or take public transportation, remember this year’s theme… Work Zone Safety: Everybody’s Responsibility.

One of the campaign’s nationwide events, Go Orange Day, is scheduled for April 11. Roadway safety professionals across the country are encouraged to wear orange to show their support of work zone safety, call attention to the dangers they face and honor the families of victims who lost their lives in work zones. In observance of Go Orange Day, the American Traffic Safety Services Association will host a Facebook Live event tomorrow at 12:30 p.m. (EST) to discuss the importance of work zone safety.

The NWZAW page has several resources for businesses, including this year’s toolkit, NWZAW poster, and other information to help get started. The toolkit includes customizable employer launch letters and press releases, fact sheets, event planners and interactive employee presentations.

Suggested Go Orange Day and National Work Zone Awareness Week activities include:

  • Posting social media announcements with #NWZAW and #Orange4Safety; and distributing NWZAW fact sheets and posters.
  • Telling friends and family. Commit to telling at least three people about NWZAW and Go Orange Day, including statistics and information about work zone safety. By spreading the word in your circle, you will have a ripple effect that will make your community more aware while in work zones.

  • Thanking a roadway worker. While it is not appropriate to pull over in a work zone to share your thanks, if you see a roadway worker out in the community, or know one that lives in your community, be sure to thank them for the work they do each day to maintain our roadways.

Booming or Busting: Samsung’s Trouble with Quality

samsung
Since its launch in August, Samsung’s rollout and subsequent recalls of the Note 7 have been severely affected by quality and safety issues as a result of the lithium-ion batteries overheating, and in some reported incidents, even catching fire. This ultimately led to an initial recall on Sept. 15, followed by many incidents of phones continuing to catch fire even with the battery “repair,” and mobile carriers halting sales of the phone.

On Oct. 11, Samsung permanently halted all production and sales of this device. Current estimates from the Wall Street Journal indicate that “investors have shaved off roughly $20 billion in Samsung’s market value, [and] the company has said the recall would cost it $5 billion or more, including lost sales.”

To make matters worse, the Department of Transportation (DOT) has now weighed in and banned passengers from traveling with the phones. The DOT has issued an emergency order to ban all Samsung Galaxy Note 7 smartphone devices from air transportation in the United States. Individuals who own or possess a Samsung Galaxy Note 7 device may not transport the device on their person, in carry-on baggage, or in checked baggage on flights to, from, or within the United States. The Samsung Galaxy Note 7 device is now considered a forbidden hazardous material under the Federal Hazardous Material Regulations.

The initial recall would be expected to directly affect sales levels of the specific phone, and it would be fair to anticipate the possibility of a financial impact from a recall. But the further problems go beyond that—they lead to broader reputational issues.

Although all recalls will likely result in some financial impact and market frustrations, an isolated event can be a well-managed, short-lived issue, with a reasonably prompt recovery. Many customers may look past a one-off instance as a bump in the road, which has been identified and corrected—an error. A second or third problem arising after addressing the initial issue(s), however, and the company’s overall quality assurance programs are put in the spotlight. Customers are now looking beyond the isolated incident and lose confidence in the brand as a whole.

The extent of the financial losses resulting from this can grow exponentially as the result of a second or third similar issue.

The suggestion now develops that the company cannot determine what’s wrong or find a solution.

It appears that happened with Samsung, leading to the announcement that they are ceasing production of the model completely. Consumer confidence takes a big hit.

This year, we have seen the impact multiple recalls have had on several companies. Samsung, along with others like Chipotle, Takata Airbags and Mattel, have suffered repeat issues stemming from an initial problem. Where a company repeatedly has quality assurance issues, direct and manageable losses can quickly grow to larger exponential ones fueled by the broader reputational harm. Appearing in the media for the first problem had a significant financial impact. Reappearing after the initial handling of the matter is a less than ideal way to restore confidence and set about moving on from the issue.

The losses Samsung will suffer now extend beyond the costs to investigate the problem, recall logistics, and rework costs. They now face the more complicated challenge of measuring the business income lost from the event. An initial recall, and the replacement of phones would have likely led to some business income loss. While this may not have been avoidable, it would likely have been manageable. Not being able to identify the problem and develop a solution, however, has led to larger reputational issues and a much larger business income impact.

New Rail Tank Car Usage Promises Safer Crude Oil Transport

Added capacity of pipelines used to transport crude oil and declining prices are contributing to decreasing transport of crude oil—and an almost 97% drop in the use of older, less safe transport cars between 2014 and the end of March, Gannett reported this week.

Rail tank car shipments of crude oil from the Bakken oil fields in North Dakota have declined from a peak of 498,271 in 2014 to 424,996 in 2015, according to the Association of American Railroads. An AAR official made the announcement at a rail tanker car safety forum sponsored by the National Transportation Safety Board, according to Gannett.

In the December 2013 report “Moving Crude Oil by Rail,” the AAR noted that the rail industry has been urging federal regulators “to toughen existing standards for new tank cars” and recommended that the estimated 92,000 existing tank cars used to transport flammable liquids, including crude oil, be retrofitted with advanced safety-enhancing technologies, or phased out if they cannot be upgraded.

While there are obvious issues with the transportation of oil by rail, the AAR has pointed out that railroads have an excellent safety record with crude, even surpassing pipelines in recent years. But the industry and federal regulators acknowledge there is much room for improvement.

The new, safer tank cars have thicker steel shells, insulating materials, full-size metal shields at each end and improved outlet valves underneath the car. Increased use of the new cars is good news for densely populated areas on the east and west coasts that have numerous trains—often of at least 100 tank cars—moving through daily.

DOT 117 train car
A transportation law, the FAST Act, signed by President Obama in December 2015, includes new mandates for freight trains transporting crude oil through the U.S. The law requires that older tank cars be replaced by the newer, safer car for shipping flammable liquids by March 1, 2018, phasing out the older model used, according to the U.S. Department of Transportation.

A rail disaster in Lac-Mégantic, Canada, on July 26, 2013, that killed 42 people brought a heightened focus on the dangers of transporting highly flammable Bakken crude oil by train.

According to the DOT, the rule also:

  • Requires an enhanced tank car standard and an aggressive, risk-based retrofitting schedule for older tank cars carrying crude oil and ethanol.
  • Requires a new braking standard for certain trains that will offer a higher level of safety by potentially reducing the severity of an accident.
  • Designates new operational protocols for trains transporting large volumes of flammable liquids, such as routing requirements, speed restrictions, and information for local government agencies.

Crude Oil Safety Mandates Signed into Law

A transportation law signed by President Obama earlier this month includes new mandates for freight trains transporting crude oil through the United States. The law requires that tank cars used for transporting crude oil be replaced by March 1, 2018, phasing out older DOT 111 tank cars for shipment of flammable liquids, including most Bakken crude oil, according to the U.S. Department of Transportation.

The new tank cars will have thicker steel shells, insulating materials, full-size metal shields at each end and improved outlet valves underneath the car.

The DOT said that the Notice of Proposed Rulemaking (NPRM) also outlines a classification and testing program for mined gases and liquids and new operational requirements for high-hazard flammable trains (HHFT) that include braking controls and speed restrictions.

The Journal News reports that the new law requires freight railroads to provide real-time data on flammable liquids shipments to state emergency response commissions (SERCs) to be shared with local first responders. The law codifies what had been a regulatory emergency order requiring trains containing one million gallons of Bakken crude oil to notify SERCs or other appropriate state-delegated entities about the operation of these trains through their states.

For the first time, the rail safety section of the new transportation law also allows states and localities to obtain inspection reports on privately owned rail bridges filed with the Federal Railroad Administration by freight railroads.

Localities will be eligible for 80% federal funding to finance safety improvements at dangerous railroad crossings.

According to the DOT, the rule:

  • Requires an enhanced tank car standard and an aggressive, risk-based retrofitting schedule for older tank cars carrying crude oil and ethanol.
  • Requires a new braking standard for certain trains that will offer a higher level of safety by potentially reducing the severity of an accident.
